Civil monetary penalties (CMPs) are available to the government to basically recover
“damages” for fraudulent, abusive and wasteful conduct. Authorized by the Social
Security Act, the Secretary of HHS has delegated many of these CMPs to the OIG.
In most cases for which the OIG may seek CMPs, the OIG may also seek exclusion from
